Angola: Parliament passes Bill on Gambling

Luanda - Angola will soon have a law to regulate the betting and gambling and broaden the tax base of the state, as the Parliament approved on Wednesday in the Generality the Bill on Gambling Activities, submitted by the Executive.


The proposal was approved during the 3rd Ordinary Plenary Meeting of the 4th Legislative Session, with 154 votes in favor, none against and 34 abstentions.

The bill, presented by the Secretary of State for Treasury, Leonel Silva, aims to regulate the activity of casino, lotteries and online games (referred to in the document electronic games), and increase jobs.

The Draft Law appears to improve the legislation in an area hitherto regulated by an Ordinance of the colonial period No. 517/70 of 16 October, outdated in the face of demographic, economic, social and constitutional reality.

It requires more legal guarantees for national or foreign citizens who exercise or benefit and also their accountability, pursuant to Article 89 of the Constitution, according to the joint opinion report of the 1st and 5th specialized committees of the Parliament.

According Leonel Silva, it is a diploma that will seek and broaden the tax base of the state, prevent and combat money laundering and terrorist financing.

The diploma, he said, is embodied in the general prohibition of gambling, except the gambling authorized by the head of the executive body.

He explained that, under this proposal, the gambling activity is exclusive to the state, and through the concession agreement, it may authorize public and private entities to explore the area.

The diploma, he stressed, also aims to create a specific grant scheme for the gambling activity, the existence of a single entity with the authority to license, supervise, monitor and inspect.

Leonel Silva said that the text includes some limitations, prohibitions, interdictions and access to gambling venues, as well as create a special tax regime for the gambling.

For this purpose, the draft law, which is divided into nine chapters and 76 articles, is proposed to regulate the following gambling: casino games, lotteries and electronic games.

 

According to the Secretary of State for Treasury, it is admitted the granting of commercial companies incorporated in Angola, with exclusive object to gambling activities, which may include complementary activities.

To do so, these companies must have good repute, financial and technical capacity, he stressed.

He added that concessions must be made by public tender, the minimum amount required for the activity is one billion kwanzas.

Leonel Silva clarified that the concession period ranges from 10 to 30 years, depending on the length of time required to amortize the investment.
